ŞİŞLİ GALEN IMAGING AND LABORATORY SERVICES TRADE LTD. CO. PERSONAL DATA PROTECTION INFORMATION NOTICE

Şişli Galen Imaging and Laboratory Services Tic. Ltd. Şti (Galen or Company) attaches great importance to the protection of your personal data. With this awareness, Galen processes all kinds of personal data belonging to individuals associated with it in accordance with the Personal Data Protection Law No. 6698 (KVKK).

Galen, as defined in the KVKK, processes your personal data as a “Data Controller” with the purposes and methods explained below, within the limits set by the legislation, carefully and diligently;

1. Definitions

Within the scope of this Information Notice;

Personal Data: Any information relating to an identified or identifiable natural person (name, surname, ID number, address, phone, system login/logout times, location, resumes, place of birth, date of birth, email address, video records, and all similar data),

Sensitive Personal Data: Any data that must be strictly protected compared to other personal data, which may cause discrimination or victimization if learned (race, ethnic origin, political opinion, religion, sect, clothing, union membership, health, biometric data, and other similar data),

Processing of Personal Data: Any operation performed on personal data, whether by automated means or not, as part of a data recording system, including obtaining, recording, storing, altering, sharing with third parties, and transferring abroad,

KVKK: Law on the Protection of Personal Data No. 6698, published in the Official Gazette on April 7, 2016,

Authority: Personal Data Protection Authority,

Data Processor: A natural or legal person who processes Personal Data on behalf of the Data Controller based on the authority granted by it,

Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system,

Data Subject: The natural person whose personal data is processed,

Galen or Company: Refers to Şişli Galen Imaging and Laboratory Services Ticaret Ltd. Şti.

2. Collection, Method of Collection, and Processing of Personal Data

The personal data of our customers, potential customers, employees, employee candidates, company officials, suppliers, business partners, employees of partner companies, visitors, and other third parties under our responsibility may be collected and processed by our Company Galen through automatic or non-automatic methods, by our relevant departments, communication forms, various contracts, emails, or similar verbal, written, or electronic means, in accordance with the Constitution of the Republic of Turkey, international treaties to which our country is a party, and primarily the Law on the Protection of Personal Data No. 6698, as well as relevant legislation.

Since Processed Personal Data may vary depending on the Data Subject, the Personal Data categories and Personal Data listed below may differ for each Data Subject and may vary according to the nature of the relevant service.

Therefore, as the Data Controller under the KVKK, we would like to inform you regarding the Processing of Personal Data.

1. Personal and Sensitive Data Collected, Obtained, and Processed by Galen

  1. Pursuant to Articles 5 and 6 of the Personal Data Protection Law, your personal data;

 

  • Will be processed in compliance with the law and the rules of honesty,
  • Connected, limited, and proportionate to the purposes of processing,
  • Accurate and, where necessary, up-to-date,
  • For specific, explicit, and legitimate purposes,
  • Stored for the period stipulated in the relevant legislation or as long as required for the purposes for which they are processed.

2. Transfer of Your Personal Data

Your personal data may be transferred domestically or abroad to our shareholders, business partners, suppliers, business connections, subcontractors, or, where stipulated by relevant legislation, to regulatory/supervisory institutions and official authorities, in accordance with Article 8 of the KVKK and limited to the purposes specified above, with necessary technical and administrative measures taken.

3. Storage and Deletion of Data

Our Company stores the processed personal data for the periods specified in laws, company procedures, and company policies.

If no period is specified in the legislation, personal data will be stored for as long as required by the services provided by our Company, in accordance with company practices and commercial customs, and after this period, only for the period necessary for possible legal disputes as evidence.

After the expiry of these periods, such personal data is deleted, destroyed, or anonymized by the methods defined in company procedures and policies.

4. Your Rights as a Data Subject

  • Within the scope of Article 11 of the KVKK,
  • To learn whether your personal data has been processed,
  • If processed, to request information about it,
  • To learn the purpose of processing and whether they are used appropriately,
  • To know the third parties to whom your personal data is transferred, domestically or abroad,
  • To request correction if your personal data is incomplete or incorrectly processed,
  • To request deletion or destruction of your personal data within the conditions set by the legislation,
  • To request notification of the correction, deletion, or destruction of your personal data to third parties with whom it has been shared,
  • To object to a result against you by analyzing the processed data exclusively through automated systems,
  • To request compensation if you suffer damage due to unlawful processing of personal data,

You have these rights.

To exercise the above-mentioned rights, pursuant to Article 13 of the KVKK, you must fill out the form available at “www.galenlab.com.tr” , and deliver the signed copy of the form to the address:

When making an application regarding your rights as a personal data subject, your request must include:

  • The matter requested must be clear and understandable,
  • The matter requested must be related to you,
  • If you act on behalf of someone else, special authorization must be documented,
  • Identity and address information must be included,
  • Identity-verifying documents must be attached,

Your applications will be concluded free of charge as soon as possible and no later than 30 (thirty) days, depending on the nature of the request. However, if the process incurs additional cost, the Company reserves the right to request a fee determined by the Personal Data Protection Board under Article 13 of the Law.

  • Pursuant to Article 28/2 of the KVKK, personal data subjects cannot exercise their rights, except for the right to claim compensation for damages, in the following cases;
  • If personal data processing is necessary for the prevention of crime or criminal investigation,
  • If the personal data has been made public by the data subject,
  • If processing is necessary for the performance of supervisory or regulatory duties and disciplinary investigations or prosecutions by authorized public institutions, organizations, or professional institutions in the nature of public institutions,
  • If processing is necessary for the protection of the economic and financial interests of the State in relation to budgetary, tax, and financial matters.

9. Cases Where Galen May Process Your Personal Data Without Your Explicit Consent Under the KVKK

  • Pursuant to Article 5 of the KVKK, Galen may process your personal data without your explicit consent in the following cases;
  • If expressly stipulated by law,
  • If it is mandatory to protect the life or bodily integrity of you or another person where you are unable to declare consent due to actual impossibility,
  • If it is necessary to process the personal data of the parties of a contract, provided that it is directly related to the establishment or performance of the contract,
  • If it is mandatory for Galen to fulfill its legal obligations,
  • If the data has been made public by you,
  • If processing is mandatory for the establishment, exercise, or protection of a right,
  • If it is mandatory for the legitimate interests of Galen, provided that it does not harm your fundamental rights and freedoms.
  1. In the event of inconsistency between the applicable legislation and this Information Notice, the applicable legislation shall prevail.

This Information Notice is published on the website “www.galenlab.com.tr“ and made available to personal data subjects. Updates and amendments may be made to this Information Notice to comply with changing conditions and legislation, and will be announced through the relevant website.
